um, this is the first user created skin. Kid made it, and now she updated it for 0.635. If your not talking about that, and ur talking about taking the design from Whistler, then I don't beleive there are any rules against that. As there was a large discussiong in a Cerulean Studios BB, most of the skins submitted in the contest, with the exception of a few great ones are, for lack of a better word, "rips". although this skin does not fit into that category, since Kid made the whole skin herslef (xml and all), with only screenshots of whistler. so, this skin is original.

from i have can tell from you picture this displays good use of color and all of trillions features (which is a plus) However, I think taking an idea that has already been thrown out and just tweaking it doesnt qualify it as an 'orginal skin'
